In Memory of Thom Brown

Thomas W. Brown passed away on Tuesday, August 20, 2024. Thom earned his bachelor’s degree in radio/television/film from the University of Texas in 1974 and his law degree from the night school program at Northwestern School of Law, Lewis & Clark College, in 1980. Thom then served as a clerk to Judge William L. Richardson of the Oregon Court of Appeals before joining Cosgrave Vergeer Kester in 1981, where he remained an integral part of the firm until his passing some 43 years later. Thom served as Cosgrave’s managing partner for 16 of those years, overseeing sustained and consistent firm success. Thom was also a preeminent appellate lawyer. On March 2, 2016, Oregon Governor Kate Brown signed legislation that will raise the minimum wage across the state through a first-of it-kind three-tiered system based on where the employer is located. Here’s Some Answers to How Measure 91 and Legal Marijuana Impacts the Workplace By Shane Swilley, Employment Law Group By passing Measure 91, Oregon joins Colorado, Washington, and Alaska in legalizing the recreational use of marijuana for individuals 21 and older. The law takes effect July 1, 2015. What does legal weed mean for Oregon employers? Here are answers to some of the questions we’ve been hearing leading up to and after the passage of Measure 91. Can I still prohibit my employees from using marijuana? Yes. Measure 91 did not include any protections for employees. Employers may still enforce their drug-free workplace policies prohibiting marijuana use, distribution and possession in the workplace and being under the

Nick Wheeler moderated “Nuclear Verdicts- Does Anybody Really Know What’s Going On?” at ALFA International’s Product Liability & Complex Torts Practice Group Seminar in Stowe, Vermont on September 27, 2024. The panel asked, is it possible to mitigate nuclear verdicts? Is it even possible to identify cases where a nuclear verdict is a risk? In response, the panel presented a number of nuclear verdicts, their similarities, and their differences, identifying common factors that drive nuclear verdicts. They discussed whether these were on-offs or part of a trend and most importantly, what can be done about them.

Dan Peterson spoke on the panel, “Protecting Attorney-Client Privilege When Wearing Your Business Advisor and Legal Advisor Hats” at ALFA International’s Business Litigation Practice Group Seminar in Park City, Utah on September 12, 2024. The panel looked at scenarios common to in-house counsel communications into the gray area and beyond. Additionally, the panel examined strategies to attempt to protect the gray areas and avoid getting pulled into the gray areas in the heat of day-to-day operations.
